Australian Migration Law is amongst the most complex legislation of it\u2019s type in the world and changes frequently. Many visa applications are refused because applicants do not fully understand these requirements or fail to provide the Department of Immigration with all necessary information and documents &#8211; or put in applications that a based on a friend\u2019s application \u2013 which was submitted before changes to migration Law were made.<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 10pt;\">Advice given by \u2018education agents\u2019 should be weighted against that agent\u2019s own interests \u2013 are they paid by the institution they represent? \u00a0Are there options <em><strong>other<\/strong><\/em> than student visas?<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 10pt;\">Unregistered \u2018agents\u2019 (<em>even those who hold \u2018ID\u2019 from the departmen<\/em>t) are not required to adhere to the<span style=\"color: #339966;\">\u00a0<a style=\"color: #339966;\" href=\"https:\/\/www.mara.gov.au\/tools-for-agents-subsite\/Files\/code-of-conduct-march-2022.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Code of Conduct<\/a>\u00a0<\/span>\u2013 are not required to maintain any kind of legal knowledge nor are they accountable to<span style=\"color: #339966;\">\u00a0<a style=\"color: #339966;\" href=\"https:\/\/www.mara.gov.au\" target=\"_blank\" rel=\"noopener noreferrer\">OMARA<\/a><\/span>\u00a0or any other regulatory control.<\/span><\/p>\n<p align=\"left\"><em><span style=\"color: #000000; font-size: 10pt;\">Having a skilled and accountable Registered Migration Agent represent you throughout the application process will ensure that the application is prepared and presented in a professional manner and in accordance with current legal and policy requirements, giving you the best possible chance of having a visa granted in the shortest possible time.<\/span><\/em><\/p>\n<p><span style=\"color: #105e87; font-size: 10pt;\"><b>What to expect from a Registered Migration Agent:<\/b><\/span><\/p>\n<p><span style=\"font-size: 10pt;\"><a name=\"__DdeLink__1803_135611297\"><\/a>\u00a0<span style=\"color: #000000;\">Migration agents registered with the Office of the Migration Agents Registration Authority (<a style=\"color: #339966;\" href=\"https:\/\/www.mara.gov.au\" target=\"_blank\" rel=\"noopener noreferrer\">OMARA<\/a>) are required to:<\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span style=\"font-size: 10pt;\">have a sound knowledge of migration law and procedure<\/span><\/li>\n<li><span style=\"color: #000000; font-size: 10pt;\">abide by a\u00a0<a style=\"color: #339966;\" href=\"https:\/\/www.mara.gov.au\/tools-for-agents-subsite\/Files\/code-of-conduct-march-2022.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Code of Conduct<\/a>.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"color: #000000; font-size: 10pt;\">All migration agents who are registered with the <a style=\"color: #339966;\" href=\"https:\/\/www.mara.gov.au\" target=\"_blank\" rel=\"noopener noreferrer\">OMARA<\/a>\u00a0must:<\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span style=\"color: #000000; font-size: 10pt;\">make clients aware of all costs &amp; the expected time involved with their application<\/span><\/li>\n<li><span style=\"color: #000000; font-size: 10pt;\">inform clients as to the progress of their application<\/span><\/li>\n<li><span style=\"color: #000000; font-size: 10pt;\">provide clients with documented evidence of total costs of and the processes of their application\u00a0<\/span><\/li>\n<li><span style=\"color: #000000; font-size: 10pt;\">keep all client information confidential<\/span><\/li>\n<li><span style=\"color: #000000; font-size: 10pt;\">not make misleading claims as to the likely success of the application.<\/span><\/li>\n<li><span style=\"color: #000000; font-size: 10pt;\">Registered migration agents are obliged to provide you with a copy of the\u00a0<span style=\"color: #339966;\"><a style=\"color: #339966;\" href=\"https:\/\/www.mara.gov.au\/get-help-visa-subsite\/FIles\/consumer_guide_english.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Consumer Guide<\/a>\u00a0(English) <span style=\"color: #008000;\">(<a style=\"color: #008000;\" href=\"https:\/\/www.mara.gov.au\/get-help-with-a-visa\/help-from-registered-agents\/steps-to-choose\/consumer-guide\" target=\"_blank\" rel=\"noopener noreferrer\">other languages<\/a>)<\/span><\/span>, a document issued by the department which provides you with basic consumer protection information.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-103 aligncenter\" src=\"http:\/\/www.imma.au\/wp-content\/uploads\/2016\/10\/Rounded-Green-seal.jpg\" alt=\"rounded-green-seal\" width=\"154\" height=\"154\" srcset=\"https:\/\/www.imma.au\/wp-content\/uploads\/2016\/10\/Rounded-Green-seal.jpg 188w, https:\/\/www.imma.au\/wp-content\/uploads\/2016\/10\/Rounded-Green-seal-150x150.jpg 150w\" sizes=\"auto, (max-width: 154px) 100vw, 154px\" \/><\/p>\n","protected":false},"excerpt":{"rendered":"<p>An application for a temporary or a permanent Australian visa is far from a simple process \u2013 there are complex legal and policy requirements that must be satisfied if a visa is to be granted.
